Om utländskt företag inte har egen ansvarig arbetslagsledare på arbetsplatsen (det vill säga som tar ansvar för arbetsplats och arbetsredskap/material till arbetstagarnas förfogande) ska det utländska företaget betala inkomstskatt i Sverige för sina anställda*. Undantag gäller om man arbetar max 15 dagar 3 ggr under ett kalenderår, dvs sammanlagt max 45 dagar under ett kalenderår.
Nya regelverket förändrar därför följande villkor vid beställning av ID06- kort:
EU/ESS medborgare anställd i Utländskt företag:
- Max 25 dagar giltighetstid på kortet om inte mottagningskvitto från Skatteverket med ansökan om inkomstskatt/A-skatt finns uppladdad i ordern.
- Max 3 månader giltighetstid om inte svenskt personnummer/samordningsnummer finns inskrivet i ordern.
- Max 24 månader om svenskt personnummer/samordningsnummer finns inskrivet i ordern.
EU/ESS medborgare anställd i svenskt företag:
- Max 25 dagar giltighetstid på kortet om inte mottagningskvitto från Skatteverket med ansökan om inkomstskatt/A-skatt finns uppladdad i ordern.
- Max 3 månader giltighetstid om inte svenskt personnummer/samordningsnummer finns inskrivet i ordern.
- Max 5 år om svenskt personnummer/samordningsnummer finns inskrivet i ordern.
*Undantag. Om ett utländskt företag har egen ansvarig arbetslagsledare på arbetsplatsen (enligt beskrivning ovan) har man rätt att nyttja 183 dagars regeln. Men då skall en begäran om dispens skickas till bolagsgranskning@id06.se tillsammans med det entreprenadkontrakt/avtal som de skrivit med sin beställare i Sverige för ID06:s kontroll.
Då Brexit trätt i kraft ändras även regler för medborgare från Storbritannien och Nordirland.
Följande villkor gäller vid beställning av ID06- kort för brittiska medborgare:
Som anställd i svenskt företag:
- Anställd har Uppehållsstatus/ansökt om uppehållsstatus:
- Ansökan från Migrationsverket bifogas och svenskt personnummer/samordningsnummer skrivs in i ordern. Giltighetstid max till 31 december 2021.
- Uppehållstillstånd från Migrationsverket bifogas och svenskt personnummer/samordningsnummer skrivs in i ordern. Giltighetstid max 5 år.
- Anställd är s.k. ”gränsgångare” (bor i annat land men arbetar i Sverige):
- Ansökan från Migrationsverket om Gränsgångarkort/brittisk gränsgångarstatus bifogas och svenskt personnummer/samordningsnummer skrivs in i ordern. Giltighetstid max 3 mån.
- Gränsgångartillstånd från Migrationsverket bifogas och svenskt personnummer/samordningsnummer skrivs in i ordern. Giltighetstid i enhet med Migrationsverkets beslut.
Som anställd i Utländskt företag:
Brittiska och nordirländska medborgare som är anställda av brittiskt eller annat utländskt företag omfattas nu enligt utträdesavtalet som en tredjelandsmedborgare och omfattas såldes av regelverket för ID06-kort för Tredjelandsmedborgare.

ID06- new regulations regarding EU / EEA and British citizens:
Since 1 January 2021, a new legislation was introduced regarding EU/EEA citizens who are sent to Sweden by their employer from their home country to work for clients in Sweden. The former regulation "183-day rule" that many employees were covered by, no longer applies.
If a foreign company doesn’t apply full management of the employees (responsibility for the workplace and work tools/materials available to the employees), must pay income tax in Sweden for their employees *. Exceptions apply if you that works a maximum of 15 days, 3 times during a calendar year, but a total maximum of 45 days during a calendar year.
Therefore, the conditions when ordering an ID06-card now change:
EU/ESS citizen employed by a foreign company:
- Maximum 25 days validity on the card unless receipt from the Swedish Tax Agency with the application for income tax/A-tax is uploaded in the order.
- Maximum 3 months validity period unless a Swedish social security number/coordination number is entered in the order.
- A maximum of 24 months if the Swedish social security number/coordination number is entered in the order.
EU/ESS citizens employed in Swedish companies:
- Maximum 25 days validity on the card unless receipt from the Swedish Tax Agency with the application for income tax/A-tax is uploaded in the order.
- Maximum 3 months validity period unless a Swedish social security number/coordination number is entered in the order.
- A maximum of 5 years if the Swedish social security number/coordination number is entered in the order.
*Exception. If a foreign company has its own management and responsibility for the workplace (as described above), you have the right to use the 183-day rule. Then a request for exemption is sent to bolagsgranskning@id06.se together with the construction contract/agreement that they signed with their client in Sweden for ID06's control.
Regarding Brexit, rules for citizens of the United Kingdom and Northern Ireland will also change.
New conditions when ordering ID06 cards for British citizens
British citizens employed by a Swedish company:
1.1 Employee has Residence status/applied for residence status:
- The application from the Swedish Migration Agency is attached and the Swedish social security number/coordination number is entered in the order. Validity period maximum until 31 December 2021.
- Residence permit from the Swedish Migration Agency is attached and the Swedish personal identity number/coordination number is entered in the order. Validity period max 5 years.
1.2 An employee is a so-called "Border crossing" (lives in another country but works in Sweden):
- An application from the Swedish Migration Agency for a Border Crosser card/British border crossing status is attached and a Swedish personal identity number/coordination number is entered in the order. Validity period max 3 months.
- Border crossing permits from the Swedish Migration Agency are attached and the Swedish personal identity number/coordination number is entered in the order. Validity in accordance with the Swedish Migration Board's decision.
British nationals employed by a foreign company
British citizens who are employed by a British or other foreign company are now covered under the exit agreement as a third-country national and are covered by the regulations for ID06 cards for Third-country nationals.
